Supreme Court stays bail of Kuldeep Singh Sengar in the Unnao rape case
The supreme court stays the order passed by Delhi High Court on December 23, 2025, which granted bail and suspended the life sentence awarded to former Uttar Pradesh MLA Kuldeep Singh Sengar in the Unnao rape case. The court further ordered that Kuldeep should not released from jail. The bench of CJI Surya Kant, Justice Augustine George Masih and Justice JK Maheshwari noted that, the interpretation of the word ‘public servant’ section 5 of the POSCO Act by the Delhi High Court could be erroneous. Delhi high court order was based on the finding that the act done by Kuldeep is penetrative sexual assault, and it does not become aggravated penetrative sexual assault since he is not a public servant under section 5 of POSCO Act, and the bail was granted on the ground that Kuldeep has already served 7 years in jail which is the maximum punishment under the law at that time.
