Please read these terms and conditions carefully before using the services. This Agreement constitutes a legally binding agreement between you ("User," "you") and Alenist Tech Private Limited ("LawyerLinked," "we," "us," or "our"), the operator of the LawyerLinked application and related services (the "Service"). By accessing, using, or registering with the Service, you signify your irrevocable acceptance of and agreement to these Terms of Use. Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these terms. You further agree to comply with all applicable laws governed and interpreted by the Republic of India.

We provide the Service on an "AS IS" and "AS AVAILABLE" basis without any warranties. If you are using the Service on behalf of another individual or entity, you represent and warrant that you are authorized to accept these Terms of Use on their behalf. We reserve the right, at our sole discretion, to alter, improve, remove, or adapt any method, feature, or service offered on LawyerLinked at any time and without prior notice. If you do not agree to any part of these terms, you must discontinue your use of the Service immediately.

1. General Terms and Nature of Service

LawyerLinked is an independent third-party platform that enables communication between clients and lawyers. We are not a law firm and do not provide legal advice.

• No Liability for Legal Services: LawyerLinked is in no way, directly or indirectly, responsible for the advice, assistance, or services provided by the lawyers listed on the platform. We have no control over the services rendered by the lawyers and will not be responsible for any issues, discrepancies, or outcomes resulting from their services.
• Varying Legal Opinions: As LawyerLinked lists multiple lawyers for the same practice area, you may receive different opinions or answers to similar legal questions. LawyerLinked takes no liability for these differing opinions and encourages you to consult with your chosen lawyer to decide which opinion to proceed with based on its merits.
• Informational Purpose: All materials and information on the Service are provided for informational purposes only and may not reflect current legal developments or variances in law across different jurisdictions. This content does not constitute legal advice and is not guaranteed to be correct, complete, or up-to-date.
• No Attorney-Client Relationship: The mere act of receiving an email, posting a query, or using the Service does not create an attorney-client relationship between you and LawyerLinked. The lawyer or law firm you engage with is solely responsible for providing services to you. Any claims arising from your relationship with a lawyer must be brought solely against that professional, and you agree that LawyerLinked shall not be liable for any related damages or costs.
• Definition of "Your Lawyer": Any reference to "your Lawyer," "your Professional," or similar terms on LawyerLinked refers to a legal professional with whom you have a formal, mutually acknowledged attorney-client relationship. Lawyers on LawyerLinked are not "your" lawyers by virtue of their presence on the platform.

2. User Eligibility and Responsibilities

• Age Requirement: You must be at least eighteen (18) years old to use the Service. For minors, a parent or guardian must accept this Agreement and guide all consultations.
• Account Information: You are solely responsible for the accuracy of the information you submit. LawyerLinked is not obligated to validate any user-provided information.
• Prohibited Conduct: You agree not to use the Service to:
  • Transmit false, threatening, abusive, harassing, defamatory, obscene, or otherwise offensive or illegal information.
  • Infringe upon the intellectual property or other rights of any person or entity.
  • Misidentify yourself, impersonate others, or misrepresent your affiliations.
  • Post advertisements or solicit participants without our prior written consent.
  • Use any device, including worms or viruses, to disrupt, overload, or impair the Service. A breach of this clause will make you liable for liquidated damages of ₹1,00,000 per day until the Service is restored, in addition to other damages and remedies.
  • Collect or store personal data about other users.
  • Use the Service for data mining or content extraction beyond personal use.
• Permissible and Impermissible Use: You may use the Service to find a lawyer for your specific needs and to obtain general legal information (a "Permissible Use"). You are strictly prohibited from using the Service to solicit, hire, or engage employees or affiliates of LawyerLinked or its listed lawyers for any purpose other than a Permissible Use (an "Impermissible Use"). Engaging in an Impermissible Use will make you liable for liquidated damages of ₹2,50,000 per violation.
• User-Generated Content: You are entirely responsible for all content you upload, post, or transmit via the Service. LawyerLinked does not guarantee the accuracy or quality of user-generated content and is not liable for any content that is offensive, indecent, or objectionable. We reserve the right, but not the obligation, to pre-screen, refuse, or remove any content at our sole discretion.

3. Scope of Services and Disclaimers

• No Endorsement: LawyerLinked does not endorse, recommend, or refer any specific lawyer, test, product, procedure, opinion, or other information mentioned on the Service. Listings and search results are based on an algorithm and user-inputted information, not on any priority driven by fees paid to us. The opinions provided by lawyers are their own and do not reflect the opinions of LawyerLinked.
• No Guarantee of Suitability: LawyerLinked does not guarantee that an online, phone, or in-person consultation is the appropriate solution for your particular legal problem. The owners, staff, and third-party professionals associated with LawyerLinked accept no responsibility for any legal events or outcomes related to services achieved through the use of the Service.

4. User Profile and Records

• Profile Function: Your LawyerLinked profile is created to store a record of your consultations and related information.
• Data Accuracy and Retention: You agree to provide accurate information and to update it as necessary. LawyerLinked reserves the right to maintain, delete, or destroy all communications and materials according to its internal record retention policy.
• Communications: You may receive newsletters, informational materials, and service-related communications from LawyerLinked. These are for general educational and informational purposes only and should not be relied upon as a substitute for personalized legal advice.

5. Intellectual Property Rights

• Ownership: The Service, including all software, design, content, and information, is the proprietary property of LawyerLinked and is protected by intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial use while your account is active.
• Restrictions: You agree not to copy, modify, distribute, sell, transfer, reverse-engineer, or create derivative works based on the Service or any part thereof.
• User Submissions: By submitting comments, suggestions, or any other content to LawyerLinked, you assign all intellectual property rights in such submissions to LawyerLinked, which may use them for any purpose without compensation to you.

6. Disclaimer of Warranties and Limitation of Liability

• "As Is" Service: Your use of the Service is at your sole risk. The Service and all content therein are provided "as is" and "as available" without warranties of any kind, either express or implied. LawyerLinked disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Third-Party Content: The Service may contain links to third-party websites and content. LawyerLinked is not responsible for and assumes no liability for any third-party content, products, or services.
• Service Interruptions: LawyerLinked does not warrant that the Service will be uninterrupted, timely, secure, or error-free. We are not liable for any temporary interruptions in service or the deletion or failure to store any content.
• Limitation of Liability: To the fullest extent permitted by law, LawyerLinked, its affiliates, and its licensors shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, resulting from your use or inability to use the Service.

7. Indemnification

You agree to defend, indemnify, and hold harmless LawyerLinked, its affiliates, and their respective officers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms of Use, or your infringement of any third-party rights.

8. Termination

LawyerLinked reserves the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service will immediately cease.

9. Governing Law and Dispute Resolution

• Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.
• Jurisdiction: Any dispute arising from or relating to this Agreement or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Ernakulam, Kerala, India.
• Waiver of Jury Trial: To the fullest extent permitted by law, you hereby waive your right to a trial in any dispute with LawyerLinked.

10. Miscellaneous

• Modification of Terms: LawyerLinked reserves the right to modify these Terms of Use at any time. The updated version will be effective upon posting. Your continued use of the Service constitutes acceptance of the revised terms.
• Assignment: We may assign our rights and obligations under this Agreement to any parent, subsidiary, or successor entity. You may not assign your rights or obligations without our prior written consent.
• Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Entire Agreement: This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and LawyerLinked regarding the Service.

User Acknowledgement

By using the Service, I acknowledge and agree to assume all risks associated with the limitations described herein. I understand that no warranty or guarantee has been made to me concerning any particular result or outcome from my use of the Service or consultations with lawyers. I understand that the information I provide will be used as defined by the LawyerLinked Privacy Policy and Terms of Use.
